The Fingerprint Inquiry, Scotland

The Report of the Fingerprint Inquiry was published on 14 December 2011.

On 14 March 2008 the Scottish Government established a public inquiry into the case of former policewoman Shirley McKie which Justice Minister Kenny MacAskill said has "cast a cloud over the individuals involved and has been a source of serious concern for the criminal justice system for the past decade."

Immediately after the publication of the findings Tom Nelson, director of forensic services at the Scottish police services authority (SPSA) issued a personal apology in public over the handling of the matter to Shirley McKie and her father Iain. See Guardian report by Eamonn O'Neill 14 12 2011.

Key recommendations of the Report include:

Fingerprint evidence should be recognised as opinion evidence, not fact, and those involved in the criminal justice system need to assess it as such on its merits.
Examiners should discontinue reporting conclusions on identification or exclusion with a claim to 100% certainty or on any other basis suggesting that fingerprint evidence is infallible.
Features on which examiners rely should be demonstrable to a lay person with normal eyesight as observable in the mark.
A finding of identification should not be made if there is an unexplained difference between a mark and a print.

INUK campaign for the reform of the CCRC

We have to at least have a review of the only way back to Court of Appeal which is the CCRC…in the past the PCA was replaced by the IPCC because it was seen to be failing…critics would even say now that the IPCC needs examining!! Any body like these has to be subject to scrutiny. The CCRC are not only second guessing how the C of A will view a case, but how the C of A viewed it previously….this should not be their priority, the whole case needs to be considered even if fresh evidence has been identified…they must look at the full picture, everything is relevant.

This campaign attempts to outline justifications for a review of current judicial procedures regarding the criminal justice system and purported miscarriages of justice. It attempts to illustrate how a department and its procedures impact upon the actions of another. One of the key issues addressed is that of the rules of disclosure. In specific instances where it is purported there has been a miscarriage of justice this process has not been addressed adequately, thus causing the search for the truth in an adversarial system such as ours to obscure the real issue of innocence, in addition to other issues such as police misconduct. This campaign does not request the Home Affairs Select Committee to address the guilt or innocence of a particular person or to intervene in the judicial process, but to review the procedures undertaken by specific government departments:

Jeremy Bamber, Susan May and Eddie Gilfoyle have written attached document which is being submitted to the Home Affairs Select Committee. It is about how the judicial system as a whole obstructs those who are wrongly convicted from obtaining documents whether they are under Public Interest Immunity or simply denied to the Defence. It also calls upon the Committee to review the processes of the Ministry of Justice departments including the Independent Police Complaints Commission (IPCC), Information Commissioner's Office (ICO), Crown Prosecution Service (CPS), Police and Criminal Cases Review Commission (CCRC) because these bodies simply do not operate effectively owing to underfunding, organizational restrictions, political agenda, incompetence and in some cases corruption.

Why does this not surprise me?? It is diabolical that in any proven miscarriage of justice those who conspired to fit the evidence around the wrong person(s) are never brought to task. To be wrongly imprisoned is horrendous and it is not about 'revenge' but wholly about justice. How is it that here in this case a 'fair trial' could not be held because of 'missing' and 'destroyed' evidence, yet most miscarriage of justice evidence is 'lost', 'destroyed', manipulated, corruptly re-written.....but the conviction remains despite this?? It is surely far too convenient to comprehend that the necessary evidence needed to run this trial was inadvertently destroyed!! Certainly I see parallels with my case and I am sure so do others who have been fitted up by corrupt police.

SISTER ISABEL

It is with sadness that I want to pay tribute to a remarkable lady, Sister Isabel, who died recently. Throughout my time in prison she wrote me often. Initially she was at the convent in Langley Middleton and through some really good friends of mine who know Isabel well she learned of my situation. She went on to do missionary work abroad but never forgot me and still wrote her inspirational letters from some far flung places. Her letters always seemed to arrive at the right time....when I was feeling particularly low...and her descriptions of where she was and the people she was helping would immediately bring me round to tell myself always, there were others in far worse circumstances. She recently came with us when we went to the Houses of Commons for a meeting about the CCRC...she was in fine form and I will remember her with great fondness. She will be sadly missed by all who knew her.

Obviously as I have said before it is great that more Universities are getting involved with Innocent projects. Michael Naughton, Senior lecturer at Bristol Uni' founded the Innocence Network UK and their work has been recognised so much. It is a fact that we need such projects because the system is fraught with so many difficulties and the CCRC seems to be under scrutiny. However on Friday 25th March there is an official opening of another Innocent Project which will allow law students at Sheffield to investigate alleged miscarriages of justice. I have been invited to speak at the opening and look forward to meeting those who have been responsible for this venture.

We had a great meeting last night. Very well attended despite the weather. The main purpose was to call for a review of the CCRC. Interestingly other issues were raised about the system in general...John McDonnell M.P said there needs to be a debate about the severity of the Court of Appeal. John is now to press forward to arrange a meeting with Ken Clarke and also the Home Affairs Committee and do an adjournment debate on the role of the CCRC and what has to be its' best practice. The general view was that in the beginning the CCRC were operating within its' original remit but over the last years a different culture, spirit and methodology has become the norm. Many are frustrated that the CCRC is not fulfilling its' organisation mission. Michael Naughton pointed out that the desire is for the CCRC to be fit for purpose. It is always trying to second guess how the Court of Appeal would treat an appeal and despite the CCRC claiming to be totally Independent, it is not because they are heavily reliant on the system. Not willing to stand up and be counted. They only wish for fresh evidence and do not treat a case as a whole. Bob Woffinden gave statistics on CCRC referrals. They have 'overturned' 304 convictions but many of those were sentence reductions, not all quashed. Some include dogs without muzzles in public places. It was not primarily set up to deal with Judicial errors. In the last 6 years 7 cases have been rectified. The CCRC he said has not been accomplishing very much at all and has had before them many cases which should have been referred. The Commission should have far better experts to examine evidence and should be nurturing such experts. Henry Blaxand Q.C felt the CCRC were worn down by a system which constantly knocks them back and he went further to say there is a problem within the Court of Appeal. He also stated that the Commission should have 11 Commissioners but now only has 9 due to cuts. He felt that there was a problem with the quality of the Statement of Reasons issued by the CCRC. In many cases the root problem comes down to a failure of original defence lawyers at trial and the reluctance of the system to acknowledge this shortcoming within its' own profession. What Henry Blaxland would like to see is a reinvigorated and better funded system than what we have now. I spoke on my case and the frustration I feel in being refused by the CCRC when the main Prosecution witnesses are now all deemed to be unreliable. My last appeal failed because the Appeal Judges stated they found those witnesses to be credible, reliable and IMPRESSIVE!!! I want those Judges to be told that those prosecution witnesses have now been found by the CCRC to be unreliable and certainly can no longer be classed as impressive. I also said that the Commission should have a face to face meeting with the applicant, something which does not happen now. By the amount of people there last night it is obvious there is a huge problem and hopefully now we can progress all the comments and areas discussed to ensure change happens. It is important for those who are fighting this system to get in touch with their own M.P and attempt to get them on board. If we can raise awareness with John McDonnell at the helm supported by his fellow M.P.s then we will be heard. Worryingly we were told that a debate was going on in the House of Lords relating to cost cutting re the review on quangos and the CCRC was listed for such a review/merger under the quangos review. We want more funding for investigations into wrongful convictions not less and as I pointed out with any body like the CCRC it has to be subjected to scrutiny just as in the past the PCA was scrutinised and replaced by the IPCC. We need a robust investigatory body which does operate independently and is willing to challenge the system. I truly believe that at its' onset and for the first few years the CCRC was doing the job expected of them. It has changed and not for the better...let us at least have a thorough review of its role and original remit and move forward to ensure we can have confidence in the system. To be wrongly convicted is the worst thing ever but to have to fight a system which is surrounded by red tape and bureaucracy just adds to the whole nightmare. Thanks again to everyone who took part last night and let us all try to get as many M.Ps on board so the problems identified can be rectified. It will not be easy but the passion shown last night will I am sure go along way to making our voices heard.

Some weeks ago the CCRC told me that they are not going to refer my case back to the Court of Appeal. Once again I hit rock bottom. It is so hard to keep pushing forward, knowing you are right...yet to be knocked back again and again. As far as I am concerned what makes this so much worse is the fact for the past 18 years I have never changed my evidence, but the senior police officer in my case has changed his numerous times and been allowed to do so. Inevitably I have constantly put many points before the CCRC on this matter...highlighting the discrepancies in his evidence and requesting they look deeper into various matters. At last they have and now state that the cumulative effect of all these findings regarding this officer would inevitably have an impact on his credibility and he would not be deemed 'impressive' as the Judges at my last appeal stated, but they go on to say despite discovering these failings it has no bearing on my conviction! This I cannot come to terms with because everything in my case from day 1 went thro' this officer and came back via him. His duplicity is perverse. He was the one who breached PACE ...who decided it was not necessary to send various forensic samples for testing from other suspects...who mislead the CPS and CCRC and my defence team about the whereabouts of forensic samples...and the list goes on. So how the CCRC can say his actions are not relevant to my conviction is beyond me. Obviously I will fight on and am hopeful I can Judicial Review the CCRC decision. As always I thank all those who continue down this long road with me...your support sustains me.

Very pleased to hear the news that Michael has been released. Inevitably I think that now Jack Straw will be inundated with similar requests to look exclusively at an individual case? I for one would certainly like to sit down face to face with Mr Straw to show him the evidence which wholly supports my innocence. I will not be alone because within our jails are innocent prisoners, some still inside way over the recommended tariff yet struggling to get our justice system to take notice. Duncan Campbell (guardian.co.uk) has just written an excellent article relating to this. I hope Michael can adjust to life outside now and look forward because of course it is not easy.
Mr Straw will be hearing from me although in the past I have sent numerous letters to him about my wrongful conviction and also about prison conditions from the various jails I was in. It will be interesting to know exactly what information the family gave Mr Straw when they met privately which in turn allowed him to do this U turn on his previous refusal to release Michael. However - a happy day for the Shields family who have to be praised for their excellent campaign.

I apologise for not entering any updates on the blog.......I've been 'out of sorts' for a while. Was diagnosed with breast cancer before Christmas '08 .....had surgery and have just finished a course of chemo' which made me very sick. However am feeling a little better and recently did an interview with the Guardian newspaper for their great project to highlight Injustice and Miscarriages of Justice - so from today my interview is on line if you go to Guardian on line and look under 'Justice On Trial'. It is so good of the Guardian to research this awful problem and be willing to highlight many cases.....I appreciate all their efforts and the work done by Eric Allison.

Absolutely brilliant news for Eddie - long overdue but one significant fact is that it took an investigative journalist, in this case Dominic Kennedy of The Times, to uncover evidence that Eddie has ALWAYS insisted was there. Ed has had 3 different solicitors and the CCRC HAS LOOKED AT HIS CASE TWICE!!! It is not acceptable that the very body which examines possible Miscarriages of Justice neglected to discover this vital information and ensure Eddie's case went back to appeal long before now!!! Ed knows I wish him well and hopefully he will very soon be released.

Suzanne Holdsworth was cleared at retrial after spending 3 years in jail for a crime she did not commit, Barri White was cleared after 6 years in prison and Colin Stagg was totally exonerated after Robert Napper admitted murdering Rachel Nickell. All 3 cases show the police in a bad light and as with any Injustice it beggars belief that the cases were not investigated thoroughly and every possible avenue examined.

The media continued to vilify Colin Stagg even after the Judge at his trail had deemed the police investigation using the 'honeytrap' was both illegal and unfair - his life was made a misery despite the trial Judge clearing him. Thank goodness for that particular Judge, Sir Harry Ognall.

Cleveland police never followed up on medical evidence known to them prior to Suzanne's trial that would have shown the baby in question had serious head injuries relating to a time when Suzanne was NOT looking after him!

I despair whenever I read of another Injustice and of course live in hope that very soon I will clear my name. One can always find at least one common factor in any Miscarriage of Justice....I can find many within all 3 cases highlighted.

The right result today, that eventually Barry has been cleared. He now has to face the difficulties of the damaging effects of prison and being wrongfully convicted, it will not be easy. I was disgusted at the statement from both the CPS and the police - yet not surprised. They may not welcome today's verdict but as well as, and rightly so, expressing sympathy towards Jill Dando's family they should also show the same respect for Barry and his family. It was and still is the police's duty to have found the right person who killed Jill ,and had they done that correctly then both families would not have been tortured for so long. I hope Barry can get his life back together now he is free from the confines of jail.

I wanted to pay respect to a wonderful lady who sadly died today. Hilary Hinchliffe began writing to me whilst I was in prison and she was so inspiring. She was passionate about Injustice and took on single handedly the case of Frank Wilkinson, who is still in jail despite having served over a quarter of a century. I was fortunate to meet up with her several times since my release and despite being in her 80's, she was the type of person one would expect to go on forever. My sympathies go to her family - she will be sadly missed by many.

Jimmy Mizen

It seems amazing that the parents of Jimmy Mizen are able to speak with such fortitude and gentleness about the person charged with their son's terrible murder. I often wonder how I would have reacted had I not been wrongly convicted and the real murderer of Aunty had been caught and dealt with. I have to say I doubt I could have been as generous as the Mizens....and yet their attitude has to be praised and commended. The obvious reaction is anger, hatred and seeking revenge, but where does that lead?? As Jimmy's Mother points out she is not willing to allow the awful loss they have suffered to destroy her family and of course it could so easily do that. Another family has been affected by all this and they too will be suffering. Although an extremely difficult and painful time for Jimmy's family and friends, the courage shown by his parents is humbling. Maybe the world would be a much kinder and understanding one if everyone could follow this example?

Sky T.V and Virgin both showed the recent documentary on my case and I want to thank all those who contacted me, left messages on my blog and the petition on my website. Following the programme I did an interview for Radio 5 Live and have been approached by other media agencies which I apprecaite greatly. I believe that the programme is to be repeated and I urge anyone who has any information about Aunties murder to get in touch because there are people out there who know more and for whatever reason chose to stay silent. 16 years have passed by, but it is never too late to come forward and the slightest piece of evidence could be crucial to resolving this ongoing nightmare.

There was a very good programme on BBC Scotland featuring the case of 2 men wrongly convicted in 1995 in Scotland. Mark Daly investigated the case for the BBC and highlighted the way the police investigation was carried out. Evidence was suppressed and vital defence testimonies were altered.....a common factor in any Miscarriage of Justice. What is significant in this case is the fact the Chief of Police in question is now the subject of a corruption inquiry. We can only therefore hope that he will be brought to account and it can then be said that the Scottish system are willing to deal with the terrible problem of police corruption which leads to the nightmare of wrongful conviction. It is only when corrupt police are brought before the courts and the mischief identified and punishment metered out, that hopefully this kind of practice will stop!

16 Long Years

It is now 16 years since my Aunty was murdered and I am still weighed down by the whole injustice. This time last year I was so hopeful that a decision would have been reached by the CCRC to send my case back to the Court of Appeal, but to date their investigation is still ongoing.

The programme on my case goes out on 30 March at 10.00pm on Sky and as always I live in hope that it may prick the conscience of those who do know a lot more about the person who murdered Aunty. I also wanted to reiterate my overwhelming thanks to those friends who continue to give their support and remain at my side on this nightmare journey. It does help to keep me positive.

A good friend of mine, Eddie Gilfoyle, has like me been fighting to prove his innocence for the past 16 years. In The Times newspaper 25 February was an excellent article by Dominic Kennedy reporting on the fact that an expert for the Prosecution at Eddie's trial in 1993 - whose evidence helped convict Eddie - now admits he got it wrong! Normally
I would be saying shame on Professor Cantor, but quite frankly I have to give respect to him for speaking out and admitting his trial evidence was wrong. If only more experts would follow suit and admit they went beyond their remit and unfairly placed unproven evidence before the Court which aided the Prosecution!

Well here we are entering another year...with hope and optimism as always. Thank you to everyone who sent good wishes and who still show support despite the passing of time. The CCRC seem to be pulling everything together re my case and tell me a decision is imminent. Of course as time goes on, interesting facts surface from other cases and I constantly refer these points to my legal team and CCRC. The latest one being the Omagh bomb trial where Low Copy DNA was criticised by the Judge. Relevent in my case because the same procedure has been used by FSS. It has always been the case that the collecting, gathering and storage of forensic samples in my case leaves much to be desired and it is not good enough to merely use supposition as to results. Something made clear by the Omagh trial Judge. Experts in any field should only give their scientific findings if indeed there are any....and not go further than their remit by offering opinions. The Meadows fiasco is proof of this. I am therefore hopeful that the CCRC will come to a favourable decision and this year I can look forward to getting my case back to the Court of Appeal and finally clearing my name. The burden of a wrongful conviction is horrendous.

Lesley Molseed murder

I hope that this time the police have the right person for the brutal murder of this little girl.. What disgusts me is the way in which the wrongful conviction of Stefan Kisco is being put forward. The excuse is that DNA technology has advanced to such a degree now, that such a mistake could no longer happen! Of course DNA can still be misused. What needs to be said is that the police all those years ago would have known that Stefan could not be the killer because he was impotent. The DID know that and hid the fact that they had 'live' sperm from Lesley which could NOT have originated from Stefan! They fitted Stefan up because it suited them and labelled him in such a way that fitted the profile of a child killer! He suffered terribly in prison. Shame on them. This man on trial now was guilty of a similar sexual offence on a girl only months after Lesley was murdered....WHY ON EARTH did not alarm bells ring at Rochdale police station then?? Why??? because they already had Stefan and it did not suit their purpose to admit how wrong they were!! I hope Stefan, his Mum and Aunty are all looking down on the latest proceedings because along with Lesley's brave Mum and family they deserve that this case be resolved once and for all.

Madeleine

I am appalled at the media frenzy to label the parents of little Madeleine MacCann 'guilty' when no concrete evidence is available. Only they know the true facts and to date nothing substantial has been brought forward to make us think that Madeleine was not abducted. It is far too easy, as I know well, to conduct trial by media and this can be so damaging. Imagine the horrors those parents are going through if this is a case of genuine abduction! People should focus on the definate issues which surround this case and stop speculating.It is also wrong, as reported in the media, that this would not have happened had this case been investigated by British police. From the situation that I am in I no longer trust the police or the British Legal system and so I would hope that the McCanns will ensure any process taken by British forensic laboratories is scrutinised thoroughly. DO get Professor Alex Jefries on board. Let us concentrate on a missing little girl, refuse to read the highly emotive speculation of the Portuguese authorities and hope that Madeleine is eventually found....alive and well. Do NOT believe all that you read in various newspapers!!

The Shocking Truth about British Justice

Sandra Lean has just published a book entitled 'The Shocking Truth about British Justice...No Smoke' , by Exposure Publishing. Sandra has dedicated a full chapter to my case and I am very grateful to the comprehensive research she has obviously done in order to highlight the most important aspects of the whole case. She has managed to get her head around so much of the evidence which exposes how wrong my conviction is. I would hope that anyone who has an interest in Injustice goes out and buys this book....it covers so much of what is wrong within the system. Thank you Sandra for all your hard work and I wish you well with the book and any future work you may do.

2 years since my release

2 years ago today I was released from prison and I would have hoped that by now I could have reorganised my life somewhat...maybe had a holiday, maybe managed to shake off the awful memories and scars which were caused by the whole Injustice and the years spent in prison...but my life is still on hold and today of all days I spent a good few hours in court!! This is an ongoing case related indirectly to my main fight to clear my name, but one which is causing me great stress on top of all else and one which is quite unbelievable. Yet again making me realise how unfair the system is. I will post a brief outline with this entry to enable any interested party to read about it. I feel demoralised by everything. I want Justice but it eludes me, I cannot pick up the pieces of my life because I carry the burden of the Injustice around with me 24/7. I feel the system is stacked against me at every turn. However a new book is due out early in May by Sandra Lean, "No Smoke, The Shocking Truth about British Justice"..published by Exposure Publishing and available at www.amazon.co.uk from 7th May. Sandra has covered my case extensively and I am grateful to her for this. Just as I am grateful to all who continue to support me, my wonderful children and friends who still use much of their time to work towards the goal of having my conviction overturned. I have said it before but it needs repeating....you are the ones who sustain me!

Here is a letter I have sent to the district judge regarding the court case I mentioned above:

For the urgent attention of the District Judge.

Dear Sir

Claim number OL202725 Oldham County Court 26 April 2007

We would be grateful if you would please put this letter before the District Judge as a matter of urgency.

Solicitor and County Court Judge Ian Brown, of Lomax Geddes, has wasted court time and caused extreme anxiety to Susan May in his relentless pursuit of payment for a bill of £2,700.

Not only do we contest the legitimacy of this bill, but it is our belief Mr Brown failed to act in Mrs May's best interests as her solicitor - a point which we will be raising with the Solicitors' regulation Authority - and that he has subsequently abused the court process and taking unfair advantage of his position as a solicitor and Deputy District Judge to hound Mrs May for payment.

WASTING COURT TIME

As a judge and solicitor, Mr Brown has a duty to the courts, and we are astounded that he should have considered it proportionate to bring a staggering 12 court applications against Mrs May over the past seven years for this relatively small amount of money – when compared to the vast cost of the wasted hours of court time not to mention his endless stream of correspondence. Mr Brown has shown a blatant disregard of the Civil Procedure Rules and more particularly the Overriding Objective. We submit that he has taken advantage of Mrs May's inability to instruct her own solicitor and her lack of knowledge of the court's process and procedures.

DISPROPORTIONATE APPLICATIONS

The Court has acknowledged that Mr Brown's actions have been over muscular. Despite this, Mr Brown has continued his pursuance against Mrs May.

Mr Brown was refused his request to place a sale order on Mrs May's house – which he already has a final charging order on – by Judge Fox at Oldham County Court on 13 September 2006. The judge questioned why Mr Brown had brought the hearing since no circumstances had changed since the final charging order was granted.

The Court also refused Mr Brown's application for a second order to be placed on Mrs May's other property, which was tenanted until last month by a 92-year-old lady paying £15 per week out of which Mrs May paid water rates and other expenses.

To ask the court to order that Mrs May sells her house, lose her future security and only source of income, (except her £70 pension) just to satisfy a demand for £2,700 is a nonsense. To waste the court's precious resources in pursuant of the applications is not reasonable, proportionate or just, and Mr Brown's insistence on this line of action is at best seriously misguided and at worst a campaign of harassment and bullying.

MR BROWN'S FAILURES TO ACCEPT INVITATIONS TO RESOLVE THE DISPUTE WITHOUT COURT INTERVENTION

Mrs May has offered, in correspondence and in court, to pay the bill in instalments, which Mr Brown has refused (see enclosed letter dated 8 December 2005, where he writes: "There is no acceptable rate to us. We wish to be paid in full…".

She had taken it upon herself to make payments of £10 per month for over a year before stopping after receipt of this letter and the Court's ruling 13 September 2006.

Mr Brown is using the current means testing application as a back door route to continue his pursuance, through the courts, of getting an additional charging order on Mrs May's second property (see enclosed letter dated 19 March 2007, where he states: "We will be content to vacate this hearing if you are prepared to give us the information as to the address of the other property. This is all we seek and we confirm that we will not be seeking to interview your tenant or correspond with your tenant unless permitted by the Court.")

The last sentence of the above mentioned letter indicates Mr Brown's intention to carry on wasting even more court time in pursuance of the sum of £2,700.

On 13 September 2006 District Judge Fox advised Mrs May she need not supply the information relating to the second property mentioned above, when he refused to grant Mr Brown a charge on the defendant's second property.

FAILURE TO ACT IN HIS CLIENT'S BEST INTERESTS

Mrs May employed Mr Brown's services as a solicitor in August 1999 as she wished to bring a negligence action against the solicitors who represented her in criminal proceedings.

A report by the OSS concluded Mrs May had a strong case for bringing a negligence claim against her trial solicitors, Mellor and Jackson, but stressed she could only open a claim after her conviction was overturned.

When the OSS solicitor passed the case to Mr Brown he was instructed to put in an application to prolong the life of the possibility to claim – instructions he went against when instead he actually submitted the claim.

Mr Brown made two glaring errors here as the claim was then ruled to have been made out of time. Mr Brown refused to appeal this decision, and Mrs May had to bring in alternative representation to successfully argue the claim to be valid (at which point the Judge criticised Mr Brown for failing to bring the relevant points up at the original Hearing).

But Mrs May was still forced to drop the claim when her appeal against conviction failed. Mr Brown's actions and failures lost Mrs May the opportunity to bring a negligence claim against Mellor and Jackson. This means that Mrs May will not be afforded the opportunity to seek redress for Mellor and Jackson's alleged negligence, which saw her wrongfully convicted.

Mr Brown obviously failed to carry out Mrs May's instructions which had drastic consequences. Further, Mr Brown failed to ensure that even basic client care requirements were fulfilled. Mr Brown still charged Mrs May for his work notwithstanding his failures.

Mr Brown issued a claim to recover the cost of his work against Mrs May. This was heard in the Stoke County Court 25 November 2002. Mr Brown admitted at that hearing that he failed to ensure that Mrs May had received his terms of business or client care letter.

At this Hearing, Mr Brown told the court he had undertaken half his work for Mrs May after sending her his care and costs letter, and accordingly Judge Chapman ordered that his bill should be halved.

Mrs May, who was serving her sentence at the time had no access to legal representation. She was in no fit state to present her case after suffering a four hour journey from prison to court in a sweat box whereupon she requested that her friend assist her as McKenzie person but was then forced to present her case double cuffed to an officer in the dock.

The representations made by Mr Brown were not correct and the court did not hear that as soon as Mr Brown sent the client care letter (after eth court ruled his service out of time) Mrs May wrote to terminate his services unless he was willing to rectify the problem caused by his failures. Mr Brown refused.

The amount Mrs May has been ordered to pay Mr Brown has continually been increased as a result of the costs of his numerous court applications.

THE COURT'S CRITICISMS OF MR BROWN'S CONDUCT

Mrs May brought in alternative representation to appeal the "out of time" ruling on Mr Brown's serving of a negligence claim against her trial solicitors. At the appeal at Oldham County Court on 12 July 2000 Judge Bloom criticised Mr Brown for failing, at the previous Court Hearing, at Oldham County Court on 2 November 1999, to identify and present well-covered legislation - had he done so, the judge said, there would have been no need for an appeal to be brought.

At Stoke On Trent County Court on 26 November 2002 Judge Chapman criticised Mr Brown for a neglect of duty in failing to inform Susan he would not be working pro bono under the same terms as Mr Jones, OSS solicitor of Jones Fitton, from whom he had taken over.

After a Hearing at Oldham County Court 28 September 2005 Judge Simpson observed that Mr Brown had made but did not pursue an application to carry the judgment to provide for instalments payments, adding that would be the usual way to determine the time for and rate of payment.

At Oldham County Court on 13 September 2006 Judge Fox dismissed Mr Brown's application for an order of sale, asking for an explanation as to why Mr Brown had applied for the Hearing when the circumstances had not changed since the last Hearing at Oldham County Court on 28 September 2004 under Judge Simpson.

VICTIMISATION

Given the relatively small sum at issue, and give the time and costs spent in pursuing the debt, we have no option than to deem Mr Brown's actions as harassment. This harassment has had a severe effect on Mrs May's already fragile health – she is now on medication for depression, fearful her home could be at risk and terrified Mr Brown's continued actions could result in her being returned to prison.

This relentless pursuit is not the action expected of a Judge of the court or a member of a profession with supposedly high standards.

If Mr Brown were to be charged for his own services the bill would run to tens of thousands of pounds – a luxury Mrs May does not have.

I invite the court to take action to cease Mr Brown's continuing pursuance of payment. Mr Brown already has security for the debt by way of the charging order on Mrs May's home. In our view, Mr Brown's actions have made a mockery of the justice system, the overriding objective and the solicitors' profession.

Mrs May cannot afford legal advice. Nor would it be proportionate for her to instruct solicitors to fight a debt action of just £2,700.

The very sad news of Sally Clarke's death

I feel so sad, yet angry because of course I know how difficult it is to try to pick up the pieces of your life after being wrongly convicted. I have spoken and written many times about the damage inflicted by such a nightmare and by life in prison. It really is impossible to relay how it makes you feel and how our lives are changed forever. It scars your soul!! Shame on the system because no one will tell me otherwise that had not Sally gone through all this, she would have been here today. The police, the legal system, the so called medical experts who readily condemned her and HMP are all contributers to her untimely death! My heart goes out to her family but they can always bring to mind how graciously she dealt with her awful ordeal.

15 years on

Today 11 March would have been my Mum's birthday and of course tomorrow it is 15 years since that fateful morning when I went up to Aunties as normal and discovered her body. Mum died whilst I was in prison and nothing heals the pain of finding Aunty and the subsequent chain of events which changed my life forever. I really do find it unbelievable that I remain convicted when there is so much evidence to prove my innocence. Obviously knowing what I know now about the whole system, from the police to the legal procedures, I would not have been as naive as to trust those people who I regarded as honest and true! The first of these are the police themselves.....all those years ago I trusted them!!! Little did I know they would manufacture and manipulate evidence to suit their aim which was to get a conviction at any cost. I trusted my original solicitor who neglected to get me a fair defence and uncover other crucial evidence which should have been put before my trial jury. And then there is the system which penalises you for the mistakes made by the original defence team! All I want is the whole case to be heard because so much of the evidence has never been put before the court, yet the rules surrounding appeals say evidence available pre trial but not used is not classed as 'new' evidence for appeal! How can that be fair and just?? My life can never be the same and the trauma of being wrongfully convicted and years spent in jail hang over me like a huge black cloud. I try to keep positive and await the decision of the CCRC in the hope that if I get back to the Court of Appeal and have my name cleared then maybe I can pick up the threads of my life and possibly move on? Thank you to all those who continue to support me and still take an interest in my case....your love and support does help sustain me.

Appeal of Angela and Ian Gay

The right result for Angela and Ian Gay after their torment of being wrongly imprisoned. Obviously this case should never have gone to court in the first place but one of the statements the couple were quoted as saying is something I can certainly relate to - and that is because of their awful ordeal they have been denied the right to grieve. On the 12 March it will be 15 years since I made that horrendous discovery, finding Aunties body. Because my fight for justice is still ongoing I still have not grieved for Aunty. When you are caught up in trying to clear your name that battle over rides all else. It is all consuming and completely takes over your life. Hopefully now Angela and Ian can try to pick up the pieces of their lives, but as I have said before they will be damaged terribly by this horrendous time, as are all miscarriages of justice. Only those who have had the misfortune to suffer being wrongly accused and subsequently wrongly convicted will know how it feels. I wish them both well and I hope they can now find some peace.

Tonight Programme on ITV

An excellent programme went out on Monday evening highlighting the fact that many jurors are too heavily influenced by the evidence given at trials by expert witnesses. They showed how the recent surge in crime series' on TV, like CSI, affects the way viewers identify with forensic evidence. Forensic science has led to huge progress in solving crime and can be a very useful tool, but there is a risk that unrealistic portrayals in TV detective programmes seduce the public into believing it to be foolproof? There are growing concerns within legal circles that jurors' faith in forensic evidence can lead to miscarriages of justice. Indeed recent successful appeals are proof of this. So often the expert witness goes beyond his or her remit and neglect to tell the jury that the science is not exact. Because the jury are influenced by the qualifications spelt out before the evidence is given, they can be both baffled by the evidence and truly believe the expert to be telling the whole truth. Mere opinions are not good enough when a persons liberty is at stake!!

Christmas Greetings

I have been going through a rough patch recently and have maybe neglected the diary by not posting on the blog.....I apologise. Because I constantly await news from the CCRC nothing else seems of consequence and with yet another year drawing to a close without further news of an appeal I became very despondant. But as I have done over so many years I tell myself that the forth coming year WILL bring better news!! Interestingly though I received a letter from my solicitor yesterday including a report he had commissioned and it contains excellent news. Better not reveal too much at this stage but I am hopeful the CCRC will find it important and this can only add to their reasons of why I should get a new appeal. So can I take this opportunity to wish everyone a very happy, peaceful Christmas and a healthy, productive New Year. Thank you all for your continued support and interest in my case and for your responses to the blog.

Tom Stephens' Arrest - Re: Ipswich Murders

I have obviously followed the recent horrific news about the murders in Suffolk. Once again the way that drugs can dominate a persons life has become evident by the explanations from the women who are desperate enough to sell their bodies (the very reason so many end up in prison!)

However seeing the news today that a man has been arrested my first thought was -' I hope he is the right one' - because of course I know how it feels to be wrongly accused and convicted and often the media can act as judge and jury before all the facts are known. This man does seem to have put himself forward as a 'suspect' which could mean he wants to be caught, but it could also mean he merely wants the attention??

What is important is that the real culprit is apprehended and not allowed to slip through the net because this man is deemed guilty too soon.

Stefan Kiszko story in Guardian

I just received the following note from Nigel:

"Your case was almost mentioned...but not quite (yet!). I hope that in the end, it will be realised how much we all owe to the memory of Charlotte Kiszko - a great woman indeed! As I understand, she planted a tree in her garden for each year her son spent in prison. I wonder if the trees are still there?"

There is an understatement on the gravestone that marks the burial place in Rochdale cemetery of Charlotte Kiszko and her son, Stefan. "A loving wife and a very devoted mother," reads the inscription commemorating Mrs Kiszko.

No one could possibly have been more devoted than Charlotte Kiszko, who campaigned tirelessly for 16 years to prove the innocence of her son, Stefan, convicted, after a bungled police investigation, of the murder of 11-year-old Lesley Molseed in 1975. This week, many years after both she and her son were buried in the vast old cemetery, a man has been charged with the murder.

It is 30 years since Stefan Kiszko, an Inland Revenue clerk with the mental and emotional age of a 12-year-old, was found guilty, and 13 since he died after a brief taste of freedom. His mother died a few months later. Could a case as shocking happen today?

The man who helped to prove Kiszko's innocence, and who acted as his mother's ally, believes we are now just as much in danger of ignoring equally egregious miscarriages of justice.

"In the current climate more miscarriages will take place," said Campbell Malone, the solicitor who took over the case and saw it through its successful appeal. "It is nonsense to suggest miscarriages of justice are less likely to happen now. We are more at risk - the climate is just as bad as it was in the 1970s when you had all the Irish cases. I am profoundly gloomy about the situation."

Mr Malone accepted that changes in the law through the Police and Criminal Evidence Act (Pace) had removed some of the dangers. Kiszko was, for instance, initially questioned without a lawyer and made his confession after being told that, if he did so, he would be allowed to go home.

In recognition of the large number of potential wrongful convictions, the Criminal Cases Review Commission (CCRC) was established by law in 1995. The commission, which has a staff of around 110, receives more than 900 applications annually and refers about 40 cases to the appeals courts.

"The CCRC are under pressure and have had their resources cut back," said Mr Malone. He cited the government's many attempts to reduce compensation paid to victims of miscarriage of justice. "In the early 1990s there was a willingness to investigate. That is no longer the case."

Two highly regarded television series, the BBC's Rough Justice and Channel 4's Trial and Error, also used to put the resources into researching such miscarriages. "Trial and Error is just a memory and the Rough Justice programmes are as rare as hen's teeth," said Mr Malone. "It's getting harder and harder to have cases reopened. It's scary."

Few new lawyers were entering the field, as such cases were time-consuming and may have been worked pro bono. Michael Mansfield QC, who has acted in many of the best known miscarriage of justice cases, agreed that there were now serious risks of the wrong people being convicted, although the reasons may have changed.

"In the 70s and 80s, there were the usual allegations of fit-up, verbals [alleged admissions] and fabricated confessions. Since Pace, that has dwindled to almost non-existent. But forensic science can be equally suspect because of the desire to convict."

He cited the case of Angela Cannings, cleared on appeal in 2003 of the murder of her two baby sons. "If that had been carefully analysed it should never have led to a conviction," he said. "There are other cases where scientific evidence is not being scrutinised carefully."

The rules on fingerprinting had been loosened rather than tightened. "Most solicitors are very reluctant to get tied up in cases of this kind and a lot of lawyers shy away from this [forensic issues] because it's very specialised," he added. He said television in the past had been able to lay out budgets that led to new information being turned up, as with cases like the Birmingham Six. A new series about miscarriages of justice, The Innocence Project, was, coincidentally, launched this week by the BBC. It is a fictional account of students investigating potential miscarriages of justice, as happens in real life at Cardiff, Bristol and Leeds universities.

A CCRC spokesman acknowledged budget cuts. "As a result of reduced funding the commission has needed to make savings without compromising the quality of the service that we provide. We are working hard to erode our backlog of cases and extra resources would obviously speed that process up."

He added: "New problem areas have emerged in recent years, such as expert evidence, disclosure and critical errors in the directions given by judges. While still rare, miscarriages of justice are still occurring and will continue to do so."

Rochdale is not short of famous sons and daughters: Lord Byron, Gracie Fields, reformer John Bright. Stefan Kiszko will be remembered not for what he did but for what he didn't do - and what was done to him. Along with his modest grave, with its vase of plastic roses, a fitting memorial might be an acknowledgement that a frightened, vengeful society can still lock up the wrong man.

5th National Miscarrige of Justice Day

A public meeting was held in Liverpool yesterday for the annual meeting of various groups involved in Injustice. Many families with very similar, sad stories. It seems to me to be very important that together we make a louder noise about this very serious problem. Obviously the individual case is upper most in the mind of that particular family but if we are to get anywhere in making changes and highlighting the problem about miscarriages of justice we need to come together to be force to be reckoned with? Meetings like is do provide an excellent opportunity to meet with some very interesting people who have worthwhile ideas of how we can move forward. Bruce Kent chaired the meeting and as always ensured things ran smoothly. A workshop was held in the morning and Andrew Green and Kevin McMahon answered questions from the floor. Speakers included Mark Curren, a former CCRC case worker and a solicitor - he gave some very interesting insights into the CCRC and how maybe it has changed from its' concept in 1997? Kevin McMahon spoke on the question of how we attempt to unravel police investigations and Luci Roper who was the partner of Graham Huckerby, cleared of armed robbery after over 3 years in jail, told of the damage done to the convicted person and to their families. Barbara Stone, sister of Michael stone spoke about Michael's case and his ongoing battle to clear his name and Satish Setar who was instrumental in helping to highlight the case of the Cardiff 5, gave a talk on the usefulness of DNA - but stressed that the collecting of samples should be removed from the police and a totally Independent body be in charge. I was the last speaker and here is a copy of what I had to say.

INNOCENT MEETING 14 OCTOBER 2006

When I spoke last year at this meeting I had only been out of prison a short while and I recall saying how damaged I felt with the whole experience of being wrongly convicted and the years I’d spent in jail. I did think that a year on I may feel better – that it may have diminished and I would now be better able to live my life outside. That is not the case and I come to the conclusion that it will remain with me forever. I have friends who came out with their convictions quashed and even they still struggle. My fight still goes on and in a bizarre way I am sure this contributes to my determination to stay strong and battle on? When I was in prison I was determined to survive the horrors of prison and of course fighting my case dominated everything…that is still the case. People say to me you should just get on with your life now but I can’t. Yes I am free of the confines of jail but I still feel ‘locked up’ because I remain convicted and until I clear my name that won’t change. I have good people around me and I am so thankful for that but I have had some serious battles since I came home. I took every avenue possible to highlight the wrong…going to the Police Complaints regarding issues surrounding the original police investigation and what went on after conviction, and that is still ongoing because I have been harassed since my release from 2 of the officers who worked on the original case and I also went to the OSS Official Supervision of Solicitors who looked into my complaint against my original solicitor and they wrote an excellent report saying he had been negligent and let me down badly and that I had a very good case to sue but not until my conviction was quashed. To cut a long story short the solicitor they appointed to deal with this was excellent, a Mr Jones, but because he could be used at a future appeal as a Defence witness and to prevent conflict of interest I was passed to another a Mr Brown of Lomax Geddes who came on board pro bono as Mr Jones had been. Mr Brown was instructed to ‘keep the case on ice’ a procedure which Mr Jones had explained…i.e. NOT to serve a writ, but to keep extending the time limit indefinitely. Without consulting me Brown went ahead and served the writ and served it out of time, therefore losing me any chance of dealing with this at a later date. Worse still, he then sent me a bill for his services!! This matter has gone on for years, I went from prison on several occasions to fight this in various courts and each time the amount owing went up as court fees were put on me. However once I came home Brown decided to put a land registry order on my home to secure the so called debt. I went to court to fight that and more costs were given, but a few weeks ago he took me back to court to force me to sell my home. After all I’d been thro it felt like the final straw and I admit I nearly went under but in my usual fashion I fought it and on this occasion I won. In fact the Judge wiped the floor with him. I tell you this tale because I feel so strongly about us having a list (of sorts) of good and bad solicitors? I’m sure you can all name solicitors who have let you down and also maybe you know of some who give you confidence…let’s name and shame and identify those who are trustworthy!! What I would also say is no matter how good you feel a solicitor is, it is vital that you still do a lot of work yourselves towards your own case. Usually once recognised as a good solicitor they take on more cases and that is why they need to be constantly pushed. The person you are campaigning for knows their case best… but you on the out should also know the case inside out. Never be afraid of badgering your solicitor…keep on at them to work on the points you know are pertinent to the case. The same applies to the CCRC. Don’t sit back once a case has been accepted by the CCRC thinking they will now do all possible – write them, if possible have contact with the case worker and send them details of what you know is relevant. Use every avenue possible, like the OSS the IPCC. Okay I am certainly not convinced the IPCC is independent, but go thro the process. Use your M.P I know I am fortunate to have a lot of support from many MP’s, my home MP Michael Meacher has been very good along with others and John Mc Donnell has been amazing. We need changes to the whole system and the way forward is to persuade MP’s we are a force to be reckoned with. We all know the rules surrounding appeals are far too stringent and John Reid’s proposals to make even more changes will cause further problems. So much of what Government propose are vote winners – this latest proposal is allegedly to prevent guilty people going free, but at what expense to those who are innocent. Rather than tighten up on appeal laws, more needs to be done to identify police procedures that cause both injustice and those who maybe are guilty being sent to trial on corrupt police procedures! If police followed their rule of law, then guilty people would not get off on a technicality and hopefully we may see fewer innocent people being sent to jail! We need to see police officers in proven miscarriage of justice cases being prosecuted. So not only do you have to fight for the individual you know to be innocent, you really do have to fight the system as a whole for everyone and for future injustices. Our voice needs to be heard. Sadly it is only usually when you become embroiled in this system by knowing someone wrongly convicted that you become aware of how flawed and faulty it is. So lobby MP’s on all these points. Do not allow them to say it is not their problem…it is!
It is uplifting to know that more Universities and students are becoming interested now since Michael Naughton started his initiative to have students study potential injustices and become involved and another point I think we should push for is this. I have had, thro Andrew Green, a retired police inspector working on my case. The work he has done to identify faults (and a lot more) in police procedures from the very onset of my case has been invaluable. Ann Whelan, who campaigned for her son and others in the Bridgewater case, once told me years ago that with almost any injustice the root damage can be traced to the very first stages of police work. And this is so true. All solicitors dealing with an injustice should be willing to employ someone like Des Thomas who has been helping me. I know that like me you may feel reluctant to trust the police in general, but lets face it when they come on board from our perspective they know exactly what goes on and can spot very easily where evidence has been neglected, misused and even buried! So that is another important issue to push for.
I have struggled since my release and could not have coped without the help from my family and friends. I am sure they see me as a different person now because I know I am. No help is available for us. I have tried to get a job but there is a terrible discrimination in the work place when you say where you have been for so many years. As soon as I disclose the word ‘prison’ It’s like I have 2 heads. I got a degree whilst in prison but it counts for nothing and you can be made to feel like a social outcast…that applies for those who have been cleared too!! But the greatest hurdle is trying to readjust. I had hoped I wasn’t ‘institutionalised’ but after years of adhering to a set regime, being so used to doing the same thing at the same time year after year it is inevitable that there is still a part of you that remains rigid in routine. It is so difficult not only for the person who has been in prison but for their families too. We must never forget that all of you have been affected too. My parting words are as always… stay strong, keep fighting, make loud noises whenever possible to those who often don’t want to listen and do not be deterred - my message is, this will not go away…I am not going to go away.

Yes I have and certainly one day I will write a book. The problem I face because I have looked into this, is because I remain convicted, publishers are wary of legal wrangles. Lets face it I need to say lots about police corruption etc. and publishers would be cautious to print - obviously once I clear my name that problem is removed.

We met in Durham prison after Sandra had been repatriated back to the U.K. from a prison in Thailand. Her story is fascinating and we remain staunch friends. Her book about her experiences, 'Forget you had a Daughter', has drawn alot of attention to my case and I shall be forever grateful to Sandra for mentioning me in the book.

T.V programme entitled 'Murder in Question'

After weeks of deliberation as to whether or not ITV were to go ahead and show my case along with 3 other cases in a programme called 'Murder in Question' it now looks very likely that my case is to be shown on Thursday 7 September at 11.00p.m.
Seemingly the legal Dept' at ITV felt the programme in its' original form had me as 'definately innocent'! BUT because I still remain convicted they could not allow that, and so certain comments and names had to be removed. Maybe they need to realise I am innocent and if that 'definately' comes through well, what can I say! It is only 24 minutes long and is a brief outline, but I always remain hopeful that any publicity will prick the conscience of those persons who DO know details of what happened on the night of 11 March 1992 when Aunty was brutally murdered, and despite the length of time which has passed, will eventually come forward and speak out.

Film to examine Dando evidence

The BBC is preparing a documentary that will examine new evidence in the murder of presenter Jill Dando.

It will focus on the findings of the Criminal Cases Review Commission (CCRC), which is examining evidence presented by lawyers for Barry George.

He has always denied the 1999 murder and in 2002 he took his case to the Court of Appeal and lost.

The BBC would not comment on the programme's content, saying it was in the "very early stages" of development.

In March George's lawyers presented their case to the commission, which has the power to refer it back to the Court of Appeal if there is a real prospect the conviction will be quashed.

His solicitors said that he was not capable of committing the crime because of his mental disabilities.

A second plank to their case was that two new witnesses said they saw armed officers at the scene when George was arrested, contrary to what police have insisted.

This was significant because the only forensic evidence that linked him with the murder was a particle from gunshot residue, his lawyers said.

The third part to the appeal was previously undisclosed psychological profile reports which suggested the person responsible was of a very different character to George.

The BBC would not comment on reports in the Mail on Sunday that the documentary would include interviews with two members of the jury that convicted George.

There are strict laws preventing jurors talking about a case they have been involved in.

But the newspaper said it was understood the jurors would not comment on the jury's deliberations, which would put themselves and the BBC in contempt of court.

A BBC spokesman said: "The Criminal Cases Review Commission is expected to announce its findings later this year, which naturally would be of interest to any current affairs team.

"Everybody involved has been liaising with BBC lawyers to ensure that the process has been legalled throughout."

He added that no broadcast date had been set yet.

Sue's Response

For a long time now I have tried to press for a more detailed procedure for juries. I know they have to be protected and remain anonymous, but it is they who seal our fate.

We can get transcripts of the trial and Judges summing up, but we have no way of knowing how the jury came to their conclusions. It is a well known fact that within a jury there will be more dominant people and this can often lead to some members being pressures and swayed into a decision. It would be very useful, especially for appeals, if we had written reasons of how the jury reached their verdict.

They could easily remain anonymous but it would point to the facts they relied on. Many of which, when it reaches appeal stage, can be discredited or other true facts can come forward after trial which will disprove the reason for giving a guilty verdict.

When delivering a guilty verdict each jury member should independently write their reasons down and merely sign..Juror 1, 2 3, etc.

It is transparency that we need in all aspects of our system.

Paisley students

When you are fighting an injustice there are times when nothing seems to move forward and you can feel very deflated and demoralised. Then out of the blue something turns up that revitalizes you and lifts morale up yet again. This week I received an email from one of the Paisley students who took it upon themselves to look at my case, especially the forensic evidence and their findings have been very helpful. So to hear from one of them again and to realise he (Chris McGrory) is still taking an interest in my case is so refreshing and a much needed boost. He left his message on "14 years on" in my blog. The update on the case is the CCRC are still working on various avenues and my solicitor is also pressing ahead with different enquiries, so things are happening and I remain hopeful that I will hear positive news soon. Thanks to everyone who continues to write, email and offer their support - it does give me strength.

Do "Offending Behaviour Courses" work?

I have grave doubts that the 'Offending Behaviour Courses' which are used extensively in all jails actually work? I had posed the question with Andrew that it would be interesting to find statistics on how many repeat offenders had gone through these courses - how many times they had repeated them and therefore exactly how useful these courses are! Findings 276 Cognitive skills programmes: impact on reducing reconviction among a sample of female prisoners

This report outlines the findings of research assessing the effectiveness of accredited and pre-accredited prison-based cognitive skills programmes – Enhanced Thinking Skills and Reasoning and Rehabilitation – on reducing reconviction for a sample of female offenders. These programmes were introduced in HM Prison Service (HMPS, England and Wales) in the early 1990's as part of the 'What Works' ethos towards offender treatment and rehabilitation. They were developed around the assumption that offenders lack appropriate cognitive skills to achieve their goals in a pro-social way and seek to address these deficits by improving skills such as communication, perspective taking and problem-solving to help enable offenders to desist from future offending.

The research found no statistically significant differences in one- and two-year reconviction rates between female offenders who participated in prison-based cognitive skills programme delivered between 1996 and 2000 and a matched comparison group. These results are similar to recent evaluations of the same programmes delivered to male adults and young offenders (Cann et al., 2003; Falshaw et al., 2003a) and are considered in the contexts of potential limitations in the theory as applied to female offenders, programme implementation and evaluation methodology.

Government Proposals to curb Compensation payments to Miscarraiges of Justice!

I want to thank those who respond to my blog. We have some very interesting comments and debates.

I am appalled at the latest proposals by the Government to curb compensation payments to proven Miscarriages of Justice. In truth no amount of compensation can make the wrong done right, but by no means should that responsibility of the terrible damage done to any one wrongfully convicted be trivialised. It is impossible to describe what it feels like. Impossible to relate how it damages both the person wrongly convicted, but also their families and close friends. To compare this with the also terrible consequences of what families of victims of crime suffer is unacceptable. The two are different issues and should be recognised as such.

The rhetoric used by the Government claiming a 'not proven' vedict would be safer and prevent lawyers earning too much money from cases, is aimed at public opinion once again. It is only when you have been affected by the nightmare of being wrongly convicted and therefore touched by what can happen in this system that you fully realise how flawed the system is and the suggested cost cutting by Charles Clarke is not the answer. If he wishes to save money then prosecute those police officers who have been found to be corrupt, yet manage to find an 'escape route' by taking long term sick leave or early retirement on full pay and pension!

I would never wish what I went through on anyone, but I would like to bet that, God forbid, if ever put in that position even for one month, Tony Blair or Charles Clarke would have very different views on how the Innocent should be regarded.

Protest at Styal Prison

I recently met with others outside Styal prison to stage a protest in order to highlight the serious problem of deaths in custody. It was a wet and very cold day but the determination of those gathered was uplifting. Some very sad stories of Mothers and Fathers who have lost loved ones through suicide whilst in jail.

Many also felt strongly about proposals to expand Styal and of course I support their
concerns. The answer does not lie in even larger prisons, but in how prisons are managed now and the way forward is to reduce the numbers of people sent to jail therefore allowing better management and obsevation of those who struggle with prison and feel vulnerable. Pauline Campbell works hard to bring about changes, she lost her
daughter in Styal.

As many know the whole system needs reforming, vulnerable, mentally ill prisoners and those addicted to drugs need far more than what is given as prison stands today.

Justice System Eroding

It was an interesting point raised by Nigel in my diary on reasons why the police target people - sometimes the wrong person!

As we all know recent changes and proposals for change by the Government to the Criminal Justice system have caused serious concerns. The new anti-terrorist laws, the abolition of the right to trial by jury amongst some of these changes and now, following the report by Lord Carter on the 'Procurement of Criminal Defence Services, market based Reform' these concerns will grow even more.

The report looks for ways to encourage early disposal of cases! It suggests just having one duty solicitor at the police station and the client, or person in custody, will have no choice in the matter. 'Like it or lump it' scenario. If the defendant insists on their own choice of solicitor, then they would have to pay privately for this service. This is a very dangerous practice.

From my experience my situation went terribly pear shaped because I had a local solicitor who had never previously dealt with a murder case before and was the duty solicitor. I was trusting at that time. After all I was innocent and 'had nothing to fear' because I even (foolishly) trusted the police! I would now, from experience, recommend anyone in such a position to appoint a solicitor from out of the area, not the duty solicitor who often can work far too closely with the police in question.

Terrible events do happen and rightly so individuals need to be caught and prosecuted. But, when someone is innocent then every precaution has to be taken and we cannot allow standards to drop or a right and proper defence to be offered.

Costing should not be in the equation when dealing with people's lives and their freedom. Too many aspects of our justice system are being eroded and I fear at a very great cost to future miscarriages of justice!

Prison Fiddling Drugs Figures

This is a response I made after mojuk published a piece on how prisons fiddle their figures relating to how much time prisoners are allowed out of cells on a daily basis.

Prison fiddling not just confined to time out of cells

Prisons also 'fiddle' figures to hide the serious drug problems in their midst! All jails have a drug problem and rather than admit that, HMP cover it up. Much more help is needed within the prison environment to help those who are addicted in the hope that addiction can be lessened whilst in custody and therefore reduce the risk of re-offending on release.

I have never used drugs but it was prisoners like me who would be regularly subjected to Mandatory Drug Testing (M.D.T) by prison staff in order to give the much needed negative results which then allowed the prison to show in their statistics that there was not a drug problem.

In 1995 the then Home Secretary, Michael Howard introduced M.D.T into the prison system. Prisoners were taken for urine samples which in turn are checked for the presence of drugs. I saw women who had only previously used cannabis in a 'spliff' begin to use heroin and even inject! I wrote letters to many including Michael Howard whilst in jail telling him he actually created a worse problem re drugs in prison?

He helped to turn some into junkies through the M.D.T system because those who needed a 'fix' soon realised that cannabis stays in the system for 28 days whereas heroin can be flushed out in 2 or 3 days. So to avoid getting a positive drug test and thus losing privileges the women switched to heroin which is I believe far more addictive and far more harmful? Hence the authorities wanting negative samples to allow their stats to hide the problem!

14 Years On

This coming weekend, the 11th / 12th March, is 14 years since the awful murder of my Aunty. It seems unbelievable that still we do not have Justice for Aunty and the fight to clear my name remains ongoing.

My life has changed so much over these long years. It is dominated by the legal wrangles I have to pursue and has totally altered my perceptions of the whole criminal justice system. I am committed to carry on the fight for as long as it takes and as always I am so very grateful to all my friends, family and others who continue to stand by me and give their support.

Women and Criminal Justice

The first one I want to highlight relates to Charles Kennedy's (Secretary of State) recent statement in the house of parliament on the matter of Women and Criminal Justice. You can read his full statement HERE

My own response to his statement now follows and is taken from the Mojuk newsletter

Charles Clarke issued a written Ministerial statement 'Women and Criminal Justice' on Wednesday the 8th March to mark International Women's Day.

Obviously we must welcome all the proposals being put forward and hope that they are realised?

Many women in prison suffer terribly from being separated from their children and the amount of self-harm is frightening.

I do feel it is necessary to promote education in prisons to help those who maybe did not achieve in school but other projects that used to run in prisons were shelved because everything now has to be 'accredited'. Thus initiatives like sewing, cookery and home making were deemed unsuitable because they did not carry accredited status.

A lot of women need help with such areas and I feel more needs to be done in this field.

What I also feel is very important is support on release. It is pointless to lock people up for the specified time and then merely release them with little, and in some cases, no support!

When in a Mother and Baby unit in prison, there is always help and support, but the worrying factor is who follows this through when the Mother and child leave the confines of the prison?

I believe far more is needed to help prisoners through the period on release when they feel vulnerable and maybe have no job - sometimes no home! Is it any wonder so many reoffend?

Malicious Police Harrassment

I had a more promising letter yesterday from the I.P.C.C (Independent Police Complaints Commission). Since I came home from prison I have been subjected to what I say amounts to malicious harrassment from a police officer in my case and made a complaint some months ago.

It is standard practice for any police complaint to be sent to the force in question initially and of course the result was that Greater Manchester Police rejected my complaint and even said they were not willing to record it! I therefore took it up with the I.P.C.C who have now told me the complaint has been upheld, it will be recorded and duly investigated.

Obviously at this stage they are not making any judgement but it is only right and proper that any complaint should be logged and recorded. Professionals like the police must be accountable for their actions and the system has to be transparent. It was promised that the new I.P.C.C which replaced the original P.C.A (Police Complaints Association) was going to have more powers and I remain hopeful that this is the case.

Sandra and I Meet with Key Productions

Sandra Gregory and I spent time last night with John and Trish of Key Productions. Also we were introduced to Graham Cooke, an academic who works along side them as a script writer.

It was a very enjoyable evening and despite Sandra and I getting back to my home before 10.30pm, it was 3.30am before we retired to bed! We just talked and talked and the time flew by.

Hopefully I will met up with Sandra again very soon. I think John and Trish have almost finished their proposed documentary on Injustice, due to be screened in June.

Paddy Hill Visit

Had a very busy day yesterday. Paddy Hill (founder of MOJO) came from Scotland and of course it is always great to see him. He is such an inspiration and always boosts my morale.

He and I went to Buckley Hall Prison to see Eddie Gilfoyle who is also fighting his case and then we went onto the film team who are making a programme on Injustice. I had already done some work with them and Paddy was filmed yesterday.

Paddy left in the evening en route to various venues he has this week. He gives so much time even now to the work on miscarriages of justice, he is a diamond!

Almost one year since my release from prison

It is getting close to one year since I was released from prison and I wanted to share what this time has been like for me. Obviously I am delighted to be able to spend time with my children and grand children, but not a single day passes where my thoughts don't go to my wrongful conviction. The CCRC are still examining my case and hopefully looking for a way forward to refer me back again to the Court of Appeal. I may be free from jail but I do not feel free. When you are wrongly convicted it takes over every thing and I am unable to 'get on' with my life still!

I have been fortunate since my release to have quite alot of media interest in my case and I am grateful for that. My campaign group is as committed as ever and we still meet monthly as they always did when I was in prison. Without the support and love of my family and friends I do not know how I would have coped following my release. Prison has damaged me and the fact I am wrongly convicted adds to
that.

It has been difficult getting used to life outside - so much has
changed, maybe I have changed because of all I have experienced?

The recent guidelines issued by Lord Goldsmith, the Attorney General, following the reviews on shaken baby cases should hopefully go a long way to helping others wrongly convicted on so called expert evidence. I have written to the Attorney General to point out how I was convicted on an expert going way beyond his field of expertise!
Something we have tried to get before the courts many times.

My Release from Prison

This is my first entry since release. A huge thank you to all who sent messages of support, flowers and phonecalls.

I am finding the transition difficult. But that is to be expected - you cannot live a structured life, as prison is, and just fit back into life outside as though nothing had happened. My main priority is to press on with the case, I know I can't relax until I am back in the Court of Appeal and my conviction is quashed. Paddy Hill and Paul Blackburn have both phoned me knowing exactly how I felt - like an alien really! That is despite being surrounded by loved ones. It helps to speak with others who have experienced the pain of wrongful convictions.

I hope to be back online soon with updates but for now thanks again,

Here we are at the beginning of another year and I throw myself into it with ongoing hope and optimism – that surely, this may be the year my case is sent back to the Court of Appeal and I receive the justice which has been denied me the past 13 years.

I want to thank everyone who sent me messages of support for Christmas and the New Year. It is impossible to say how heart warming and sustaining that support is.

Christmas in prison can be a painful time, New Year’s Eve even more so. We say goodbye to a past year and even if that year has not been a particularly good one, I find it sad that it leaves us forever. Never possible to retrieve any part of it. Happy memories from the past fade even further away.

But New Year’s Day 2005 began on a much happier note – my 5th grandchild was born. I was able to keep in contact with my daughter throughout her labour, by telephone, so that allowed me to feel closer to her. It is especially at times like this, that this terrible injustice hurts so much!

I am hopeful that by February the CCRC will have some vital reports which have been expected for a while and more definite decisions can be made about my situation.

Hope from the CCRC

Well, October is upon us. The Autumn and a reminder that yet another year is passing by.

There has been quite a bit of activity from the CCRC and my hopes and expectations have risen once again. As always, these things will take their time and apart from continuing to go over…and over…all the pertinent points which I believe are crucial to my case and relaying again and again these points to those who are working on my case, I can only wait and be patient, forever hopeful.

Running alongside the efforts to get me back to the Court of Appeal is the Parole Process! I never thought I would still be in prison at this stage and really have no interest in ‘Parole’ as such. Obviously the prison has to do their job and I appreciate that. I have never worked towards getting released by ‘Parole’ and therefore cannot predict its outcome. It will not be unconditional and therefore were it to be granted, I would have to see what conditions were laid down because I will never compromise my position as an innocent prisoner, merely to gain release. As time goes by, all this gets so much harder

The letters I receive and messages of support via the web help so much. Thank you for your interest, for caring and for being there in my ongoing struggle.

London Press Conference

I was very sad to hear of the death of Paul Foot. A great man with a passion for justice and not afraid to speak out when he suspected wrongdoing. I shall always be grateful to him for taking an interest in my case,

Forensive Students' Paper

Each year when the 5th May comes around, inevitably it is a very difficult time for me. Really my year does not begin on 1st January - but on 5th May and each passing year the pain of my wrongful conviction gets worse.

I do not believe many people have fully understood the forensics relating to my case - Judges certainly have not taken the time to look at the catalogue of errors or what the forensics tell us and of course this evidence is crucial.

However, students studying forensic science at a University in Paisley in Scotland have totally understood. They used my case for a paper they were doing and have produced an excellent document.

I am so very grateful to them - as I read it, I thought "at last", this is exactly what we have been saying for all these years. I am hopeful the hard work the students have put into this can now be used to help provde my innocence. I say a Big Thankyou to these forensic science students who I am sure will have great careers ahead of them.

Yet again "Hope" comes alongside and renews my faith that the truth will out.

Health Improvement

I thought I should give you all an update on my health. Although I am no longer on any thyroid medication, I am gradually feeling better. It seems that my thyroid levels have regulated - I go back to the hospital at the end of this month, so I am hoping for a favourable result.

Because of the situation I am in it can often be difficult to fully be sure that I feel okay. Inevitably I regularly feel "drained", but I am sure that is more than likely due to my ongoing struggle to clear my name.

On a brighter note, I have been very interested to read all the reporting on the Angela Canning appeal judgement. Of course much of this concentrates on the tragic events of cot death. However, at long last, maybe further discussions will follow on so called "expert" witnesses in other cases. It is a well known fact that these experts may be under pressure from the Prosecution to "massage" their findings in order to strengthen the Prosecution case.

I also feel strongly that a jury should hear from both an expert from Prosecution and one from the Defence. I was very badly advised pre-trial, that this was not necessary - consequently, my jury only heard Prosecution "expert" evidence! That evidence has now been discredited, yet amazingly, I remain in prison!

Hope will return

I was overwhelmed by all the lovely cards I received for my Birthday - thankyou. I so appreciate all the wonderful messages - gifts and flowers.

Another year draws to a close - it brings with it an odd, despondent feeling. Throughout the year(s), I have constant hope that any day the breakthrough news I so long for will come, however at ths time of year you have to reliase that everything related to the justice system starts to wind down - even stop and you know for a fact you definately will not hear of that necessary progress until, at least, the following year. And so it goes on - "HOPE" will resurface in January 2004!

For anyone at all interested in prisons - the system in general - I recommend you read "Prison Gate" a book written by Sir David Ramsbottom, the ex-Chief Inspector of Prisons. It really is a true account of the failings within this system. I was fortunate enough to meet Sir David on a number of occasions and I had written several letters to him. He always responded and was very attentive to any comments about prison. If only the Government would act upon all the recommendations Sir David made.

Inner Strength

Throughout my time in prison I have done my best to keep fit and well - always dreading the thought of being ill in prison! However, I have recently had problems with an over-active thyroid and was due to have treatment for this at hostipial. The hospital decided not to "offer" me the treatment and I was left "in limbo" knowing I was feeling much worse, yet not being given anything to "level" my thyroid out.

Last week I did feel the full weight of all my years in prison, as though the whole injustice was pressing down on me and burning me out. I was terrified that I may never "get up" again!

For anyone wrongly convicted - you have to find inner strength and draw on that. You wonder how you do it. Where does it come from?

And yet, so much comes from people who care - family, friends and even people I don't know in person, but who take time to send messages of hope, both to me direct and through my website. I just want you all to know, you do make a difference - THANK YOU.

Wonderful Autumn Colours

Looking through my window today - I am mesmerised by the beauty that this time of year brings. The wonderful colours on the trees - bronze, yellows, reds and greens. Leaves are constantly breaking free from the branches and gently floating down to form a carpet of autumn hues.

And yet this beauty also makes me feel so sad.

Throughout my time in prison, I have used the seasons as a measuring stick - always hoping the particular season will be the final one I see through a prison window. Autumn tells me yet another year is drawing to a close and I sit and wonder if I shall have to be in prison for another autumn?

I remember a poem I once read which ends... "nothing is certain, only Spring is certain"

A Tribute to Kevin Callen

I want to pay tribute to Kevin Callen who died recently.

When I came to prison, Kevin wrote to me from Wakefield prison - he too had been wrongly convicted. We became firm friends and Kevin helped me a lot in those early years.

Sadly, Kevin was introduced to drugs whilst he was inside and even though he cleared his name and went home, he still found life very difficult. He remained very angry and bitter about the injustice he had suffered and of course I fully understand that. I feel "damaged" by what has happened to me - Kevin did not overcome the damage and succumbed to drugs and alcohol. It cost him his life - I will always remember him and the advice and support he gave me.

Foston Hall Transfer

Since coming into prison in 1993 I have been told many times by varying prison staff that unless I admit guilt, show remorse and take part in the designated offence related work, then I will never get out of prison. I am totally innocent of the crime I am convicted of and if it means I stay in prison until a court eventually admits my conviction is unsafe - I say so be it - I will not jump through hoops in order to gain my release - even though my heart breaks when I speak to my children.

Parole reports for a life sentenced prisoner normally begin 3 years before tariff expiry date. That time had passed when HMP Newhall began preparing reports for parole. The lifer governor at Newhall and my personal officer both stated that because I maintain my innocence they could not recommend me for open conditions. They did not deem me "safe" to be moved to an open prison!

I transferred to HMP Foston Hall and refreshingly found an entirely different approach. The lifer Governor there said that a prisoner's progress should not be halted purely on the reason of maintaining innocence - an addendum report was done by Foston Hall and I now find myself in an open prison. I am actually suprised, because I never thought I would get to an open jail. The same situation remains though - I am innocent and only wish to be viewed as "me" - I will not participate in any prison "offense" work.

Sally Clark Freed!

Excellent news for Sally Clark, I am so happy for her.
I pray that now, Judges will scrutinise expert evidence used at trials. It should be the truth - it should not be exaggerated, nor should it be coloured in such a way that it leans to either the Prosecution or the Defence. It should never be misconstrued.

Let us have fairness and fair play. Let Juries hear the TRUTH!

Another Year

Another year draws to a close. I will soon start my 11th year in prison. At this time each year I feel relief that an 'od' year is passing and tell myself the new year has to bring hope - bring good fortune.

For an innocent prisoner, prison is aweful at anytime, but at Christmas time, it is very difficult. I actually feel it is equally, if not more, painful for our loved ones at home.

Inside prison, we know our restrictions - the food we get, what we are limited to buy from prison canteen and even the times we will be locked up.

Outside, our families & friends are surrounded by the "trappings" of Christmas yet are reluctant to let their hair down. They feel bad if they enjoy themselves, they think of us when they eat good food. We are always in their minds and consequently, their lives, in part, are on hold too.

With any injustice, it is not just the prisoner who suffers, but their family and subsequently, friends. I cannot say enough first how all the support I receive does help - that, and my faith sustains me. I came across this text from Romans (12.12) "Be Joyful in Hope, patient in affliction, faithful in Prayer."

Be Happy Rob

Despite the Home Office claiming they do not penalise those prisoners who maintain their innocence, Robert Brown spent 26 years in jail before his conviction was quashed on 13 November.
Wonderful news - but evidence which could havaec leared his name was withheld for years! WHY!

Those police who investigated this murder must be held to account - until this happens and corrupt polie are punished, injustice will continue to flourish.

Rob Brown is in the Court of Appeal on Wednesday - when I am at my lowest, it is people like Rob I bring to mind. He has spent 26 years in jail - my thoughts and prayers will be with him, I truly hope his conviction is quashed and he walks free.

Another year

November!! I cannot believe another year is drawing to a close and I will be spending my 10th Christmas behind bars.

The CCRC are working on my case, my friends are, as always, working hard in many directions and John McDonnell MP is organising a group of MPs who will form the "Parliamentary Friends of Susan May." I am very grateful to John McDonnell for all his efforts.

I am attempting to remain strong and hopeful - but it isn't easy. Thanks to all those who signed the petition - you do help me survive.

I can see more Sky

Just a note to let everyone know I am now at HMP Foston Hall, Derby, DE6 5DN - this will be yet another experience in the journey I am travelling. Each prison is different, with obviously good & bad points - Foston is certainly a more relaxed prison, with lovely gardens and an animal sanctuary. It is early days, but already I feel better here. For one thing, I can see far more of the sky.

Easter Thoughts

Spring is official and Easter almost upon us. I always feel this is a very special time of year - a new beginning. Spring flowers will be popping their heads out of the soil, I anxiously watch the trees I can see for birds and signs of greenery. All this gives me hope and helps me think of the future

My Sister

All 3 of my children have birthdays in January. These dates make me so sad. I have missed far too many of their birthdays, missed so much, My beloved Mum died 5 months after I came to prison. My 3 Grandchildren have been born - it really hurts.

My sister died...

I always believed she would eventually tell me why she lied:
Why on the day after I discovered Aunty's body - did you tell the police I would not let you visit Aunty! How could you lie like that? Was that said merely to cover up your problem with alcohol? Did you worry about criticism because you hardly ever visited Aunty or Mum? That is the only reason I feel?

But Ann, there was no need for you to say such things - I was so hurt - but kept telling myself that one day you would speak out and tell the truth - about the money and other things. But that can't happen now? I know you were ill - but I also think you were mentally ill. It was a wasted life. Sadly, I think the police "used" you - knowing your state of mind

Oscar Wilde

This is taken from The Ballad of Reading Gaol by Oscar Wilde. He wrote it whilst serving a two year prison sentence in Reading Gaol prison. I find it so pertinent. Whenever I walk around, I constantly watch the sky. I tell myself "Eyes skyward".
I am very aware of changes in seasons - watching trees change, noticing the colours - and a favourite pastime, watching the birds.

All of this is a constant reminder of life beyond the walls.

Always hope

Seeing Steven Downing walking down the steps of the Court of Appeal a free man thrilled me. It helps when I see a conviction overturned - I tell myself there is always HOPE.

I am disgusted with my judgement. It allows police officers a free hand to neglect taking any notes at the scene and furthermore decide years later "how it was"!

Losing this appeal has hit me hard, but I am bouncing back, encouraged by the support and ongoing work of my marvellous friends.

About Me

I am Susan Hilda May, a very ordinary woman. I was brought up to trust the police and I am sure that I trusted the whole system. I was foolish to do so!

My mum and Aunty were my life, along with my 3 children. Mum lived with me - Aunty lived alone but I went 3 times each day to check she was okay and to take her meals. I think I needed to see Aunty as much as she looked forward to my visits. She was a pleasure.

Mum went each weekend to stay with Aunty, but I would still go several times during the day. My children would also pop up to see Aunty and they enjoyed it when Aunty came to our house for tea. I suppose my life was centred around caring for my children, Mum, and Aunty. I got great pleasure from all this.

I can honestly say that I do not think I have dealt with the horror I came upon that morning of 12 March 1992. I went as I always did to check Aunty was up and about - the scene I found was horrendous. It was traumatic and devastating. I understood that because I was the last person to see Aunty, and I discovered her battered body, the police needed to speak to me. I wanted to help them all I could. I trusted them!
I was unbelieving when 18 days later I was arrested - for Aunty's murder! Still I believed they would realise they had made a terrible mistake.

That was 10 years ago - and I know the police manufactured evidence - perjured themselves (on oath) at my trial and subsequent appeals! Interestingly enough - changing their statements at each event!!

I attempt to still have faith in British Justice - but find it very difficult to understand how some judges can dare to say my conviction is safe after all the compelling evidence put before them.

I am fortunate to have numerous people outside prison, who have digested my case and are also disgusted with the workings of the system.

I have always said my fight is not with the Prison Service - but I am struggling to cope with prison life, knowing I should not be here.

Please, if anyone has information about Aunty's murder, come forward. Being imprisoned for a crime I did not commit is unbearable...
